BRIEF DESCRIPTION OF CLIP: Clip from the trial of OJ Simpson. Marcia Clark is arguing a motion for reconsideration. Judge Ito asks her whether the statute applies to criminal law, and she responds that it does not. Judge Ito asks her if the case was Shepardized and she looks at her associate who confirms that it was and that no criminal law cases applying the statute were discovered. Judge Ito them responds that his law clerks, who Shepardized the statute, found some cases applying the same to criminal law. He conclude by commenting to Marcia Clark that she could be sanctioned under Rule 11.
